With plant variety rights newly discovered or bred plant varieties can be protected. Thus, breeders should be able to be reasonably compensated for costs incurred during the breeding.

According to the Austrian plant variety protection act the duration of protection of plant varieties is at least 25 years and 30 year for trees and vines, hops and potatoes. Use for experimental purposes and for the creation of new varieties is excluded from the protection.
